Please read these Terms of Service ("Terms") carefully before using Tap2CRM. By creating an account or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.
1. Who We Are
Tap2CRM ("we", "us", "our") is a WhatsApp-based customer relationship management platform operated from South Africa. For any questions regarding these Terms, contact us at info@devrocket.co.za.
2. The Service
Tap2CRM provides a multi-tenant, shared-inbox platform that connects to the WhatsApp Business Cloud API operated by Meta Platforms, Inc. The service allows your team to manage WhatsApp conversations, contacts, templates, and related communication workflows from a single interface.
The service is provided on a subscription basis. Features and limits are described on our pricing page and may change with reasonable notice.
3. Eligibility & Account Registration
To use Tap2CRM you must:
- Be at least 18 years of age;
- Be a duly authorised representative of the business entity you are registering;
- Have a valid WhatsApp Business Account ("WABA") approved by Meta;
- Comply with WhatsApp's Business Policy and Meta's Platform Terms at all times.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Free Trial
We offer a 14-day free trial. A valid payment method is required at sign-up. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically commence and your payment method will be charged.
5. Subscription & Payment
Subscription fees are billed monthly in advance in South African Rand (ZAR). Payments are processed securely via PayFast. By providing your payment details, you authorise us to charge the applicable subscription fee on each billing date.
All fees are exclusive of VAT. If VAT applies to your transaction, it will be added at the prevailing rate.
Meta API costs are separate. Tap2CRM connects to Meta's WhatsApp Cloud API on your behalf. Meta charges certain message categories (marketing, utility, authentication templates) directly to your WhatsApp Business Account. These costs are not collected by us, are not included in your Tap2CRM subscription, and may vary by country and message type. See Meta's pricing page for details.
6. Cancellation & Refunds
You may cancel your subscription at any time from your billing settings. Upon cancellation, your workspace remains active until the end of the current billing period. We do not offer pro-rata refunds for partial months unless required by applicable law.
We reserve the right to suspend or terminate accounts for non-payment after a grace period of 7 days from the failed payment date.
7. Acceptable Use
You agree not to use Tap2CRM to:
- Send unsolicited bulk messages, spam, or messages that violate WhatsApp's Messaging Policy;
- Send illegal, defamatory, fraudulent, or harassing content;
- Impersonate any person or entity;
- Attempt to gain unauthorised access to other workspaces, the platform infrastructure, or third-party systems;
- Reverse-engineer, decompile, or attempt to extract the source code of the service;
- Resell or sublicense access to the service without our written consent;
- Violate any applicable law or regulation, including but not limited to the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.
We may suspend your account immediately and without notice if we determine, in our sole discretion, that you have violated this section.
8. Your Data & Content
You retain ownership of all data, contacts, and message content you store in Tap2CRM ("Your Content"). By using the service, you grant us a limited licence to store, process, and transmit Your Content solely to provide the service to you.
You are solely responsible for the lawfulness of Your Content and for obtaining any consents required under applicable law (including POPIA) from your contacts before messaging them via WhatsApp.
9. Data Protection (POPIA)
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 ("POPIA") and our Privacy Policy. By using the service, you acknowledge that you have read and understood our Privacy Policy.
To the extent that you process personal information of third parties (e.g. your customers) using Tap2CRM, you are the Responsible Party under POPIA and we act as an Operator on your behalf. We will process such data only on your documented instructions and in accordance with POPIA.
10. WhatsApp & Meta
Tap2CRM is an independent service and is not affiliated with, endorsed by, or in any way officially connected with Meta Platforms, Inc. or WhatsApp LLC. WhatsApp® is a trademark of WhatsApp LLC. Your use of the WhatsApp Business Cloud API is governed by Meta's own terms, and you are solely responsible for compliance with those terms.
11. Availability & Uptime
We aim to maintain high availability but do not guarantee uninterrupted service. Downtime may occur due to maintenance, third-party outages (including Meta's API), or events beyond our control. We will endeavour to provide advance notice of planned maintenance where possible.
12. Intellectual Property
The Tap2CRM platform, including its software, design, trademarks, and content (excluding Your Content), is our exclusive property and is protected by applicable intellectual property laws. Nothing in these Terms grants you any rights to our intellectual property.
13. Limitation of Liability
To the fullest extent permitted by South African law, Tap2CRM shall not be liable for:
- Any indirect, incidental, special, or consequential loss or damage;
- Loss of revenue, profit, data, goodwill, or business opportunity;
- Costs of substitute goods or services;
- Any loss arising from your use of or reliance on the WhatsApp Business Cloud API or Meta's platforms;
- Any loss arising from unauthorised access to your account where you have failed to maintain reasonable security of your credentials.
Our total aggregate liability to you in connection with the service shall not exceed the total fees paid by you in the 3 months immediately preceding the event giving rise to the claim.
14. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot be excluded under South African law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Tap2CRM and its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with: (a) your use of the service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of a third party.
16. Modifications to the Service & Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or via an in-app notice. Continued use of the service after the effective date of the revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cancel your subscription before the effective date.
17. Termination
We may suspend or terminate your account and access to the service at any time if you breach these Terms, if required by law, or if we cease to offer the service. Upon termination, your right to use the service ceases immediately. You may request an export of Your Content within 30 days of termination, after which it will be deleted from our systems.
18. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa. We encourage you to contact us first at info@devrocket.co.za to resolve any dispute informally.
19. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision. These Terms constitute the entire agreement between you and Tap2CRM with respect to the service and supersede all prior agreements.
